Rules for Foreigners who have not been issued residence certificate

Foreigners who have not been issued residence certificate (i.e. holders of F, L, C or G type visas), and those who are under study or interim programs in China and the families of holders of Employment Visas shall not work in China. In special cases, employment may be allowed when the foreigner changes his status at the public security organs with the Employment License secured by his employer in accordance with the clearance procedures, under these Rules foreigners changes his status at the public security organs with the Employment License and receives his Employment Permit and residence certificate.
Any foreigner seeking employment in China shall meet the following conditions:
 (1) 18 years of age or older and in good health;
  (2) with professional skills and job experience required for the work of intended employment;
  (3) with no criminal record;
  (4) a clearly-defined employer;
  (5) with valid passport or other international travel document in lieu of the passport (hereinafter referred to as the "Travel Document")
3.Application and Approval
The employer when intending to employ a foreigner, stall fill out the Application Form for the Employment for Foreigners (hereinafter referred to as the "Application Form") and submit it to its competent trade authorities at the same level as the labour administrative authorities together with the following documentation:

(1)年龄满18周å²ï¼ŒæŒæœ‰æœ‰æ•ˆçš„æŠ¤ç…§ã€è¯ä»¶å’Œç¾è¯ï¼›
(2)本人具有将è¦ä»Žäº‹çš„工作所必需的技能和专业知识;
(3)å—è˜é›‡çš„外国人将è¦ä»Žäº‹çš„工作是è˜é›‡å•使œ‰ç‰¹æ®Šéœ€è¦éžè¯¥å—è˜è€…ä¸èƒ½è¿›è¡Œçš„æŸç§å·¥ä½œï¼Œå¹¶ä¸”è¿™ç§å·¥ä½œç”±å¤–国人担任ä¸è¿å国家有关政ç–和法律规定;
(4)æ¥ä¸å›½ç•™å¦çš„外国人在å¦ä¹ 期间ä¸èƒ½ç”³è¯·å°±ä¸šï¼Œå¦‚果就业必须是ç»å›½å®¶æ•™å§”åŒæ„办ç†äº†é€€å¦æ‰‹ç»çš„。
3ã€ç”³è¯·å’Œæ‰¹å‡†ã€‚未å–å¾—å±…ç•™è¯ä»¶çš„外国人和æ¥ä¸å›½ç•™å¦çš„外国人在ä¸å›½å°±ä¸šï¼Œç”±è˜é›‡å•ä½å‘劳动ã€äººäº‹éƒ¨æˆ–其授æƒçš„çœè‡ªæ²»åŒºã€ç›´è¾–市劳动ã€äººäº‹åŽ…ï¼ˆå±€ï¼‰æå‡ºä¹¦é¢ç”³è¯·ï¼Œç»æ‰¹å‡†åŽå‘给就业许å¯è¯ã€‚但是,ç»å›½åŠ¡é™¢å¤–å›½ä¸“å®¶å±€æ‰¹å‡†è¢«è˜ä¸ºä¸“家的或其他有特殊需è¦ï¼Œç»åŠ³åŠ¨ã€äººäº‹éƒ¨å’Œå…¬å®‰éƒ¨é—¨è®¤å¯çš„部ã€å§”è˜é›‡çš„人员除外。
4ã€è¦æ±‚和注æ„事项。
(1)外国人就业申请被批准åŽï¼Œè˜é›‡å•ä½åº”当与å—è˜é›‡è€…ç¾è®¢è˜é›‡åˆåŒï¼ŒåˆåŒå†…容必须符åˆä¸å›½æ”¿åºœæœ‰å…³æ³•律法规,è˜é›‡åˆåŒå‰¯æœ¬å¿…须交原批准机关备案。
(2)外国人在ä¸å›½å°±ä¸šçš„许å¯è¯æœ‰æ•ˆæœŸä¸ºä¸€å¹´ï¼Œå…¶å°±èŒå•ä½ä¸Žå°±ä¸šè®¸å¯è¯çš„æ³¨å†Œè˜é›‡å•ä½å¿…须一致。就业期满åŽï¼Œè˜é›‡å•ä½è¦åœ¨å¤–国人离èŒåŽ10日内将就业许å¯è¯é€€äº¤åŽŸå‘è¯æœºå…³ã€‚如需延长就业许å¯è¯çš„æœ‰æ•ˆæœŸæˆ–å˜æ›´è˜é›‡å•ä½ï¼Œåº”å‘原å‘è¯æœºå…³ç”³è¯·åŠžç†æˆ–å˜æ›´æ‰‹ç»ã€‚就业许å¯è¯åªèƒ½å»¶æœŸä¸€æ¬¡ï¼Œå¹¶ä¸”ä¸å¾—超过一年。就业许å¯è¯å»¶æœŸæˆ–å˜æ›´åŽï¼Œåº”到公安机关办ç†å±…å› å˜æ›´æ‰‹ç»ã€‚
(3)国内从事ç»è¥æ´»åŠ¨çš„ä¸ªä½“æˆ·ä¸å¾—è˜é›‡æœªå–å¾—å±…ç•™è¯ä»¶å’Œæ¥ä¸å›½ç•™å¦çš„外国人。
(4)就业许å¯è¯å¦‚有é—失或æŸå,è¦ç«‹å³å‘原å‘è¯æœºå…³æŠ¥å‘Šï¼›ç”³è¯·è¡¥é¢†æˆ–æ¢å‘。
(5)外国在ä¸å›½å’ŒåŽä¾¨ã€æ¸¯æ¾³åŒèƒžåœ¨å›½å†…的常驻机构,包括外国驻åŽä½¿é¢†é¦†å’Œè”åˆå›½é©»åŽä»£è¡¨æœºæž„,或独资ã€åˆèµ„ã€åˆä½œä¼ä¸šè˜é›‡æœªå–å¾—å±…ç•™è¯ä»¶å’Œæ¥ä¸å›½ç•™å¦çš„å¤–å›½äººï¼Œä¹Ÿè¦æŒ‰æ¤åŠžæ³•åŠžç†å®¡æ‰¹æ‰‹ç»ã€‚
